What to check before you sign a Melbourne H&L contract

House and land contracts in Victoria are almost always two separate contracts: a land contract with the developer, and a building contract with the builder. That matters because your cooling-off rights, deposit caps, progress payment schedules and warranty coverage are set independently on each.

  • Confirm the land contract's cooling-off period in writing
  • Confirm the builder is VBA-registered in the correct category
  • Confirm domestic building insurance is arranged BEFORE deposit
  • Read every "provisional sum" line item in the building contract
  • Note any Section 173 agreement on the parent title
  • Check whether GAIC applies to the parcel

What is a house and land package in Melbourne?+

A house and land package is a bundled offer where a developer sells you the land and a builder contracts to build a specific home design on it. In Victoria this is almost always structured as two separate contracts - one for the land, one for the build - which gives you cooling-off and deposit protection on each independently.

Can I use the FHOG on a Melbourne house and land package?+

The First Home Owner Grant applies to new builds in Victoria that meet the current State Revenue Office cap and eligibility rules. Most house and land packages qualify by design. Confirm your specific contract against the SRO's FHOG page (linked below) before assuming.

Which Melbourne growth corridor has the shortest build times?+

Build times are driven more by builder throughput than by corridor. That said, corridors with reactive clay soils (parts of Wyndham, Melton) can add weeks to site works, and corridors with more established infrastructure (Casey, Whittlesea) tend to have faster connections. A responsible builder will quote a range and explain the drivers.

How do I inspect a Melbourne house and land package before I sign?+

Visit the display village for the builder's design (usually on-site at the developer's estate), inspect the block in person (not just the plan), get a soil test if one is not already available, and check the parcel on VicPlan for any overlays. A licensed conveyancer will review both the land and building contracts before you sign either.

    DB-U for unlimited domestic work. Check it on the VBA register and the disciplinary register.

    DBI is mandatory before more than a 5% deposit. No certificate, no deposit.
