Platform Terms of Use

Effective: 1 March 2026

These Terms of Use ("Terms") govern your use of the BuildPilot platform. They apply whether you visit the website, use the workspace, download a guide, request an opportunity, or interact with BuildPilot about general platform features.

If you have engaged BuildPilot's paid One to One Support service, a separate One to One Support Agreement governs that specific service. These Terms still apply to your general use of the platform alongside that agreement.

By accessing or using the platform, you confirm you have read these Terms, you agree to them, and you have the legal capacity to do so. If you do not agree, please do not use the platform.

1. About BuildPilot

BuildPilot is operated by GSTUDIO Pty Ltd, an Australian proprietary company trading as BuildPilot. We are based in South Australia and operate a building-industry navigation, recommendation, advertising and opportunity platform.

In plain English, BuildPilot helps:

  • consumers navigate the building journey, learn what to expect at each stage, save and organise their project, and discover suitable businesses, products, opportunities and services;
  • businesses gain visibility, advertise their services, and receive qualified opportunities that align with what they offer.

BuildPilot is not, and does not act as:

  • a builder, building contractor or licensed building practitioner;
  • a real estate agency, vendor, developer or property owner;
  • a finance provider, credit provider, credit assistance provider, or holder of an Australian Financial Services Licence;
  • a project manager, certifier, surveyor, engineer or building inspector;
  • a party to any building, supply, sale, finance or service contract you enter with a third party.

Except where expressly provided under a separate signed One to One Support agreement, BuildPilot does not provide architectural, drafting, design or building services through the platform itself.

BuildPilot may provide project planning, design guidance, concept development, builder matching and One to One Support services under a separate signed agreement. Those services are governed by the applicable One to One Support Agreement and not these Platform Terms.

Any contract for actual building work, design work, the supply of products, the provision of finance, the sale of property, or any other regulated service is entered directly between you and the relevant business. BuildPilot is not a party to those contracts and is not responsible for performance, quality, price, regulatory compliance or outcomes under them.

2. The Platform - what we provide

The platform includes any current or future feature offered by BuildPilot, such as:

  • educational content, guides, glossaries and articles;
  • matchers, recommendation tools and qualification questionnaires;
  • a workspace where you can save briefs, milestones, checklists, documents and shortlisted businesses;
  • AI-assisted tools (for example, quote comparison, design visualisation, AI guidance);
  • business listings and profiles;
  • house & land, land and property listings supplied by third parties;
  • introductions to businesses that may be suitable for your project;
  • advertising and featured business placements;
  • communications about your project, the platform and related opportunities.

Some features are included; some require a subscription; some are paid services. We may change, add or remove features over time. Where a change materially reduces a paid feature you have purchased, we will tell you and you may cancel your subscription as set out below.

3. Who can use the platform

You must be at least 18 years old to use the platform. By using it, you confirm you are 18 or over, the information you provide is accurate, and you will keep it up to date.

The platform is intended for use in Australia and is designed around Australian building practices, regulators and consumer law. If you access it from outside Australia, you do so on your own initiative and are responsible for compliance with the laws of that country.

Foreign jurisdiction warning.

BuildPilot does not target users outside Australia. We do not warrant that the platform, its content, our recommendations, the businesses listed, or any tool or guide complies with the laws, regulations, advertising standards, consumer-protection regimes, data-protection regimes (including the EU GDPR, UK GDPR, California CCPA, or any other foreign equivalent), or building / construction frameworks of any country other than Australia. If you access the platform from outside Australia you do so on your own initiative, at your own risk, and you are solely responsible for complying with the laws of your own jurisdiction. To the maximum extent permitted by law, BuildPilot accepts no liability arising out of your use of the platform from outside Australia. These Terms are governed by the laws of South Australia and the courts of South Australia have exclusive jurisdiction over any dispute (see section 16).

4. Accounts and security

Some features require you to create an account. You agree to provide accurate and current registration details, keep your login credentials confidential, not share your account, and let us know promptly if you suspect unauthorised access. You are responsible for activity that occurs under your account, except where we are responsible at law. We may suspend or close an account that we reasonably believe is being used in breach of these Terms or in a way that creates a risk to other users or to the platform.

5. Acceptable use

When you use the platform, you must not:

  • use it for any unlawful purpose, or in a way that breaches a law, regulation or third-party right;
  • copy, scrape, harvest or systematically extract content using automated means without our written permission;
  • reverse engineer, decompile or attempt to derive the source code of any platform component except as permitted by law;
  • post or transmit content that is misleading, defamatory, offensive, harassing, infringing or otherwise unlawful;
  • impersonate another person or misrepresent your affiliation with any business;
  • interfere with the platform's security, integrity or availability, or attempt to gain unauthorised access;
  • use the platform to send spam, phishing messages or unsolicited commercial communications;
  • use the platform to compete with BuildPilot or to operate a competing service.

We may remove content, restrict features or close accounts that breach this section.

6. AI and automated systems

The platform uses artificial intelligence and other automated systems to assist with features including (among others) recommendations, matchmaking, content generation, quote comparison and visualisation tools.

We use models provided by reputable third-party AI suppliers. These providers may change over time. Our current Privacy Policy describes the categories of providers we work with and the position we take on training opt-outs.

When you use an AI-assisted feature:

  • the output is indicative and general in nature, not personalised professional advice;
  • the output is not guaranteed to be accurate, complete, current or fit for your specific circumstances;
  • you should verify any information with appropriately qualified and licensed professionals before acting on it;
  • no fully automated decision is made about you that has a significant effect on you without a human in the loop;
  • where data you submit is processed by an AI provider, it is processed under those providers' terms and our contracts with them, which restrict training use of your personal information.

Some AI-assisted features are reserved for paid subscribers. If we materially change which features are AI-assisted, we will update these Terms.

7. How recommendations and business introductions work

When we recommend a business, shortlist businesses for you, or introduce you to a business, the recommendation is based on suitability criteria, which may include the information you have provided about your project; location, timing, budget and stage of your build; the business's services, capacity, accreditations and area served; and our editorial assessment of fit.

The order of organic recommendations on the platform is determined primarily by suitability, available information, platform criteria and user requirements. Businesses cannot pay to influence the order of organic recommendations.

Featured, Sponsored and Advertised placements are separate from organic recommendations - they are paid placements, are always clearly labelled, and appear in distinct visible slots so you can tell them apart. The existence of a commercial arrangement (referral fee, opportunity fee, advertising fee, featured placement fee or subscription) with a business does not change where that business appears in our organic recommendations. A recommendation is not an endorsement of, or warranty about, the business or its services.

BuildPilot may manually review, assess, qualify, verify or validate opportunities before introducing users to businesses. BuildPilot may contact users to obtain additional information regarding their project, budget, requirements, timing or suitability before forwarding an enquiry or opportunity to participating businesses.

BuildPilot reserves the right not to forward an enquiry where insufficient information has been provided, or where the enquiry appears unsuitable, incomplete, misleading, fraudulent or otherwise inconsistent with the purpose of the platform.

We may make recommendations based on information supplied by the business or available in public records. You are responsible for independently verifying licences, insurance, references, pricing, contract terms and suitability before engaging any business.

You consent to BuildPilot sharing relevant parts of your project brief (such as build type, suburb, bedrooms, timing and budget range) with a small number of suitable businesses we may introduce, so that those businesses can respond to your enquiry. We do not share information beyond what is necessary for that purpose, and we follow our Privacy Policy when we do.

Business status classifications

Businesses displayed on the platform may be identified using statuses such as Listed, Verified, Featured, Sponsored or similar classifications.

These classifications indicate the level of information, verification, visibility or participation associated with a business on the platform. They do not constitute a recommendation, endorsement, guarantee, warranty or representation regarding the quality, suitability, capability, licensing, performance or financial standing of that business.

Business information supplied by third parties

Business profiles, listings, advertisements and related content may contain information supplied directly by the business. While BuildPilot may moderate content, BuildPilot does not independently verify all information displayed and users should conduct their own enquiries before relying on any business profile, claim, credential or service description.

No guarantee of opportunity or outcome

BuildPilot does not guarantee that a user will receive responses, quotes, proposals, inspections, finance approval, property opportunities or introductions as a result of using the platform.

Outcomes depend on factors outside BuildPilot's control, including the availability, willingness, capacity and decision-making of participating businesses. Use of the platform does not create any entitlement to a specific opportunity, quote, introduction or result.

8. Advertising and featured placements

The platform displays advertising and featured business placements. These are clearly labelled as Sponsored, Featured, Advertisement or with a similar visible identifier so you can tell them apart from editorial recommendations.

We do not endorse, verify or warrant the products, services, claims, pricing or performance of any advertiser or featured business. We do not act as an agent for any advertiser. Your dealings with advertisers and featured businesses are solely between you and them, and you should make your own enquiries before relying on their content.

9. Land, house & land and property listings

The platform shows land listings, house & land packages, concept floor plans and related property opportunities. Almost all of this information is supplied by third parties, such as developers, land vendors, selling agents, builders and their representatives. You acknowledge that:

  • BuildPilot is not the owner, developer, vendor, selling agent or builder of any property advertised, unless we expressly say otherwise on the listing;
  • BuildPilot does not independently verify all information supplied (although we do moderate listings for obvious errors);
  • prices, availability, inclusions, plans and timelines are indicative only and subject to change without notice;
  • concept designs are illustrative - councils, site conditions, soil, energy ratings, overlays and other factors may require changes;
  • site costs, council fees, stamp duty, finance and selection upgrades are typically additional to advertised prices unless stated;
  • you must independently verify all information with the relevant agent, developer or builder before making any commitment.

All land listings, house and land packages, property opportunities and related content are additionally governed by the BuildPilot Property Listings Disclaimer and Policy, available at /legal/property-listings. Users should review that policy before relying on any information displayed on the platform.

10. Subscriptions, billing and cancellation

Some platform features are available on a subscription basis. The subscription tier you choose, the fees and the billing frequency are shown at the point of sign-up.

Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price, unless you cancel before the renewal date. We will tell you in advance if we change the price.

Cancellation. You can cancel a subscription at any time through your account settings, by contacting us, or by following the cancellation steps shown on the relevant page. Cancellation takes effect at the end of the current billing period - you keep access until then.

Refunds. Subscription fees are paid in advance and are non-refundable for the period you have already used, except where a refund is required by the Australian Consumer Law or other applicable law. Where you have a right to a refund under law, we will honour it. Where we make a material change that reduces a paid feature, we will offer a fair pro-rata refund of the unused portion.

Failed payments. If a payment fails, we may suspend paid features until payment is restored. Taxes. Prices are inclusive of GST where applicable, unless we state otherwise.

11. Your content

The platform lets you submit content - project briefs, photos, documents, notes, reviews, profile information and similar material ("Your Content"). You retain ownership of Your Content. By submitting it, you grant BuildPilot a non-exclusive, royalty-free, worldwide licence to host, store, process, display and use Your Content for the purpose of operating and improving the platform, providing the features you have requested, and (where you have asked us to) sharing relevant parts of it with businesses we introduce you to.

You confirm you own or have the right to submit Your Content, that Your Content does not breach the law or the rights of any third party, and that Your Content is accurate and not misleading. We may moderate, edit, hide or remove Your Content if it breaches these Terms or the law, or if we receive a credible complaint. If you submit a review, our Reviews Policy applies.

12. Our intellectual property

The platform, its software, design, content, branding, tools, recommendations, methodology and AI prompts are owned by BuildPilot (or licensed to us). You are granted a personal, non-exclusive, non-transferable, revocable licence to access and use the platform for your own non-commercial purposes in accordance with these Terms. You may not copy, distribute, republish, reverse engineer, commercially exploit, train an AI model on, or create derivative works from BuildPilot's content or platform without our written consent, except where allowed by law. Where we publish open-licensed material, the licence terms are stated on the resource itself.

13. Third-party services and links

The platform may include links to, or integrations with, third-party websites, products and services. We provide these for convenience. We do not control them and are not responsible for their content, accuracy, availability, security, privacy practices or terms. Your use of any third-party service is governed by that provider's terms.

14. Privacy

How we collect, use, store and disclose your personal information is set out in our Privacy Policy, which is part of these Terms. By using the platform, you consent to the handling of your personal information in accordance with the Privacy Policy and the Privacy Act 1988 (Cth) and its Australian Privacy Principles. If a notifiable data breach occurs under Part IIIC of the Privacy Act, we will notify affected individuals and the OAIC as required by law.

15. Electronic communications

By using the platform, you agree that we may communicate with you electronically - by email, SMS, in-app notification and similar means - about your account, your enquiries, transactional matters and (where you have consented or implied consent under the Spam Act 2003 (Cth)) related platform updates. You consent to receive electronic signatures, agreements, notices and disclosures, and you agree they satisfy any legal requirement that those communications be in writing. You can withdraw consent to marketing communications at any time. Transactional communications cannot be opted out of while your account is active.

16. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Where we are permitted to limit liability under the Australian Consumer Law - for example, in relation to services not of a kind ordinarily acquired for personal, domestic or household use - our liability is limited, at our option, to supplying the relevant service again or paying the cost of having it supplied again.

17. Disclaimers

The platform is provided "as is" and "as available". We do not warrant that the platform will be uninterrupted, error-free, secure against all threats, or that any information on it is complete, current, accurate or fit for your particular purpose, except to the extent guaranteed by law (see section 16). We specifically do not warrant the performance, workmanship, pricing, timing or financial stability of any business; the accuracy of third-party content; the outcomes of AI-assisted features; or that any project will be approved, certified, financed, completed on budget or completed within any particular time. You are responsible for your own decisions and for engaging your own licensed professionals where appropriate.

18. Liability

Subject to section 16, and to the maximum extent permitted by law:

  • BuildPilot, its directors, employees, contractors and related entities are not liable for any indirect, consequential, special or punitive loss, or for loss of profits, revenue, savings, opportunity, data or goodwill, arising out of or in connection with your use of the platform;
  • BuildPilot is not liable for any loss arising from the acts, omissions, performance, insolvency or contract disputes of any builder, designer, supplier, advertiser, agent, developer, finance provider or other third party;
  • where our liability cannot be excluded but can be limited, our total aggregate liability to you for all claims arising in any 12-month period is limited to the amount you have paid to BuildPilot in that period, or AUD $100, whichever is greater.

This section does not apply where the law does not allow this limitation.

19. Indemnity

You agree to indemnify BuildPilot, its directors, employees, contractors and related entities against any liability, loss, claim, damage, cost or expense (including reasonable legal costs) arising from your breach of these Terms; your breach of any law or third-party right; content you submit to the platform; or your dealings, contracts, disputes or interactions with any business, advertiser, developer, agent, finance provider or other third party. This indemnity does not apply to the extent the loss is caused by BuildPilot's own negligence, wilful default or breach of these Terms.

20. Suspension and termination

You may stop using the platform at any time and may close your account through your account settings or by contacting us. We may suspend or close your account, or restrict your access to features, if you materially breach these Terms and do not remedy it within a reasonable time after we ask you to; if we reasonably believe your use creates a risk; if required by law or a regulator; or if we discontinue the relevant feature. Where we close your account for reasons other than a breach by you, we will give you reasonable notice and refund any pre-paid subscription fees on a pro-rata basis. Provisions that by their nature should survive termination - IP, indemnity, liability, governing law and privacy - survive.

21. Changes to these Terms

We may update these Terms from time to time. Where a change is material and adverse to you, we will give you reasonable notice (at least 30 days where practicable) by email, in-app notice or a prominent notice on the platform, and you may close your account before the change takes effect if you do not agree with it. Where a change is not material, we may publish the updated Terms without prior notice. Your continued use of the platform after a change has taken effect means you accept the updated Terms.

22. Things outside our control

We are not liable for any failure or delay in performing our obligations under these Terms to the extent caused by events beyond our reasonable control, including acts of nature, fire, flood, storms, pandemics, war, civil unrest, governmental action, industrial action, internet or telecommunications failures, third-party service outages or cyber attacks. Where such an event continues for more than 30 days, either party may end the affected arrangement on written notice.

23. General

Entire agreement. These Terms, together with the documents they refer to, are the entire agreement between you and BuildPilot about your use of the platform. Severability. If any part is unenforceable, the rest continues to apply. No waiver. A failure or delay to enforce any right is not a waiver. Assignment. You may not assign your rights without our consent. GSTUDIO Pty Ltd may assign or transfer its rights and obligations on reasonable notice. Relationship. These Terms do not create a partnership, joint venture, employment or agency relationship.

24. Governing law and disputes

These Terms are governed by the laws of South Australia. You and BuildPilot submit to the exclusive jurisdiction of the courts of South Australia, and courts entitled to hear appeals from them. Before starting a court proceeding, both parties agree to attempt to resolve the dispute through good-faith communication. Nothing prevents either party from seeking urgent injunctive relief at any time. If you are a consumer, you also retain access to any external dispute resolution scheme or regulator (such as the ACCC or OAIC) available to you under Australian law.
