- Confirm the entity is not under external administration on the ASIC register
The boundary setback rule most first-time buyers miss
A pergola with a solid or semi-solid roof (louvre, polycarbonate, tile) counts as a "building" under Clause 54 and must meet ResCode side setback rules - typically 1-1.5m from the boundary depending on height. An "open" pergola (roof beams only, no infill) is generally exempt. This distinction changes the achievable footprint on narrow lots. Get your builder to check the ResCode setback before finalising design.
