Your Melbourne inner-north council approval guide
The City of Yarra covers Melbourne's dense, historic inner-north, Richmond, Fitzroy, Collingwood, Carlton North, Abbotsford and more. It has the highest concentration of Heritage Overlay-affected properties in metropolitan Melbourne. Almost any external work on a property in a Heritage Overlay (including demolition, painting, new construction, and additions) requires a planning permit BEFORE you can get a building permit. Yarra is not a growth-corridor council, the challenges here are heritage, character, height limits and neighbour objections, not GAIC.
Heritage Overlays, everywhere
A huge share of Yarra's residential streets sit inside a Heritage Overlay. A planning permit is triggered for demolition, construction (including sheds and garages), external alterations, and even repainting a heritage-listed facade. Book a pre-application meeting with a Yarra planner before finalising design, a plan that "works" in a growth corridor is often unbuildable here.
Character areas + neighbourhood character policy
Even outside formal heritage overlays, Yarra's Neighbourhood Character policy dictates setbacks, height, roof form and material palette. Warehouse-conversion territory (Cremorne, parts of Collingwood) has different rules again.
Height limits + built-form controls
Yarra has strict discretionary height limits on many activity centres (Bridge Rd, Smith St, Brunswick St, Swan St), usually 4-6 storeys. Overshadowing, ResCode Standard B21 (Overlooking) and Standard B22 (Overlooking) trigger frequent VCAT reviews.
Parking + traffic
Inner-Yarra parking permits are heavily restricted. New builds may need to demonstrate zero-car or one-car parking provision, plus bike parking. This has design implications for narrow blocks.
Victoria separates planning permits (about land use, from your council) and building permits (about construction methods, from a Relevant Building Surveyor). You usually need the planning permit FIRST, then the building permit.
Check zoning + overlays
Use VicPlan (planning-schemes.app.planning.vic.gov.au) or your council's interactive map to identify the zone, any heritage overlay, character area, environmental overlay or growth area zone that applies to your block.
Planning permit (if required)
If your project needs a planning permit (most heritage / character-area / larger developments do), lodge with your council. VicSmart is a fast-tracked pathway available for some minor applications.
Appoint a Relevant Building Surveyor (RBS)
The RBS must be appointed by the OWNER (not the builder). Choose either a municipal or private building surveyor. This is a legal requirement in VIC.
Building Permit Number (BPN) via BAMS
Your RBS applies for a 13-digit BPN through the Building Activity Management System (BAMS). Since 26 November 2025 a new formula for the Calculated Cost of Works (CoW) applies. New BAMS reporting fields (including mandatory architect status) took effect 20 March 2026.
Building Permit Levy
Required for works costing over $10,000. Rate: 0.00064 general levy + 0.00064 DBDRV levy of the CoW. Pay via the BPC secure portal (BPAY or card). Your RBS cannot issue the permit until the BPN is received.
Construction, inspections + occupancy
Build proceeds under RBS inspection at prescribed stages. On completion, the RBS issues an Occupancy Permit (or Certificate of Final Inspection for extensions).
These are STATE fees, identical across every Melbourne council. Your council may charge additional planning-permit application fees on top, see per-council notes below.
A VicSmart planning permit (for eligible minor works) clears in 10 to 30 business days. A standard heritage-overlay planning permit runs 3 to 8 months, driven by referrals to Heritage Victoria, neighbour notification (which triggers 14+ days of objections), and requests for information. Once your planning permit is issued, the building permit adds another 2 to 4 weeks with your Relevant Building Surveyor. Realistic combined total in Yarra: 4 to 10 months for a standard heritage-street renovation, 6 to 14 months for a new dwelling replacing a heritage-listed cottage.
For a Heritage Overlay planning permit application in Yarra you'll typically need: (1) Site plan + all elevations drawn by a qualified architect or draftsperson, (2) Heritage Impact Statement written by a qualified heritage consultant, (3) Photographic survey of the existing building and streetscape context, (4) Materials + colour palette schedule, (5) Roof plan showing form + pitch. Budget $6,000 to $18,000 for the full document set from your consultants. The Heritage Impact Statement alone runs $2,000 to $6,000, it's the single most important document.
Three patterns dominate: (1) Overlooking / overshadowing objections from neighbours, Yarra's narrow blocks and 2-3 storey terraces make ResCode Standard B22 (Overlooking) the most-litigated clause in inner Melbourne. Screen all first-floor windows or expect a VCAT hearing. (2) Heritage impact disputes, Yarra planners will refuse a permit if your Heritage Impact Statement doesn't clearly explain how the design responds to the heritage significance of the place. Boilerplate statements get bounced. (3) Bridge Road / Smith Street / Brunswick Street height overreach, most applications proposing more than 4 storeys on these strips end up at VCAT. Budget 6 months and $30,000+ in legal + expert fees if you go that route.
