  1. STEP 1

    Understand what a building lawyer covers

    Building and construction lawyers specialise in the legal framework around residential construction: contract review, variations, disputes, defective work claims, home indemnity insurance claims, and Consumer and Business Services SA proceedings. They differ from general property lawyers who focus on sales and title.

  2. STEP 2

    Engage at contract review stage, not dispute stage

    The highest-leverage engagement is 30 to 60 minutes of contract review before you sign the builder contract. Fees are modest and the identified issues can save many multiples of the fee later. Late engagement (after dispute arises) is more expensive and less impactful.

    Confirm specialisation in residential construction

    Not every lawyer with a "building" tag actually specialises in residential construction. Ask for evidence: how many residential building contracts have they reviewed in the last 12 months? How many CBS SA matters have they handled? Specialisation matters more than firm size.

    Get fee estimates for defined scopes

    Discuss the interaction with home indemnity insurance

    Home indemnity insurance protects the client if the builder becomes insolvent, dies, or disappears. Claims are made through the insurer, typically QBE or similar. A building lawyer knows the claim process and can significantly improve claim outcomes.

  8. STEP 8

    Ask about mediation before court

    CBS SA offers mediation services for building disputes as a first step. Mediation is typically much cheaper than court, and many disputes resolve at this stage. A lawyer should recommend mediation before litigation for most residential disputes.

    Understand cost recovery in disputes

    In building disputes, the losing party typically pays some portion of the winning party legal costs. This "loser pays" principle affects the risk-benefit of pursuing a claim. A lawyer should explain the cost-benefit before you commit to a course of action.

    Get everything in writing
