How to build to AS 3959 for bushfire compliance

STEP 1

1. Wall construction requirements

External walls must resist ember attack and, at higher BAL levels, radiant heat.

At BAL-12.5, standard masonry, concrete, brick veneer and rendered walls generally comply. Timber cladding may require specific detailing. Fibre cement is compliant.

At BAL-19, timber cladding restrictions tighten. Fire-resistant cladding types (fibre cement, masonry, metal) are the mainstream choice.

At BAL-29, timber cladding is generally not acceptable except for specific rated products. Masonry, metal or fibre cement dominate.

At BAL-40 and BAL-FZ, only specific rated masonry, concrete, or steel-clad wall systems are acceptable. Timber elements are essentially eliminated.

The transition zones between walls (window frame junction, corner details, junction with roof) must also meet the required BAL performance. This is often where compliance fails.

STEP 2

2. Roof construction and detailing

Roof construction is the most vulnerable point in a bushfire-prone home because embers accumulate in roof valleys and can penetrate through gaps in tile roofs or unsealed metal roofs.

AS 3959 requires ember-proof detailing at all roof penetrations, valleys, ridges, and gutters. Standard tile roofs require sarking beneath the tiles to prevent ember penetration between tiles. Metal roofs require specific gasket detailing at all fastenings and joints.

Gutters and downpipes must be resistant to ember-driven leaf litter fires. Metal gutter guards are typically required at BAL-19 and above.

Roof eaves are a specific vulnerability. Boxed eaves with fibre cement soffit lining are the mainstream compliant detail. Open eaves with exposed rafters are generally not compliant above BAL-12.5.

STEP 3

3. Window and door requirements

Windows and doors are ranked highest priority for bushfire protection because they are the primary breach points for embers and radiant heat.

At BAL-12.5, standard glazing is acceptable with the addition of aluminium or bronze insect screens on all opening windows.

At BAL-19, toughened glazing may be required on windows exposed to significant ember attack.

At BAL-29, all windows and doors within specific exposure zones must be bushfire-rated. This typically requires toughened glass and specific frame details.

At BAL-40 and BAL-FZ, all windows and doors must be certified bushfire-rated products. The certified product pool is small; lead times are longer than standard windows.

Sliding doors are the highest risk category. Bushfire-rated sliding doors are expensive and often difficult to source. Some high-BAL designs eliminate sliding doors entirely in favour of hinged bushfire-rated doors.

STEP 4

4. Decking, subfloor and openings

Elevated decks and subfloor spaces are common ember-attack points. AS 3959 sets specific requirements for these areas.

Timber decks at BAL-12.5 can be constructed of standard timber with specific detailing. At BAL-19 timber deck boards must be tightly fitted with restricted gaps. At BAL-29 and above, timber decking is generally not acceptable; steel, concrete or specific bushfire-rated composite deck boards are required.

Subfloor spaces (under raised timber floors) must be sealed against ember entry. Ember-proof mesh (typically 1.8mm aperture) is required around the perimeter and at any vents.

External services penetrations (aircon lines, plumbing, electrical) must be sealed against ember entry. Any hole in an external wall that is more than 3mm across must be either sealed or fitted with an ember-proof cover.

STEP 5

5. Getting AS 3959 compliance signed off

Compliance with AS 3959 is signed off by the builder at construction completion, as part of the building consent process. Documentation typically includes: the BAL assessment; the specific product certifications for wall, roof, window and door products; and photos or inspection records of key details.

The private certifier or council building surveyor inspects at key stages: framing, cladding, and completion. Non-compliance identified at inspection requires remediation before further work proceeds.

Common failure modes: exposed eaves without soffit lining; unsealed penetrations for services; timber deck boards with gaps exceeding tolerances; standard glazing on windows within required exposure zones.

A builder new to bushfire work often underestimates the documentation burden. Confirm at contract stage that the builder has completed at least one similar-BAL build in the last 12 months and can produce the compliance package as part of the contract deliverables.

Practical tip

Compliance failures typically emerge at the completion inspection, when they are expensive to fix. Build them into the contract as fixed-price deliverables, not provisional items.
