Victorian Managed Insurance Authority (VMIA) domestic building insurance covers you if your registered builder becomes insolvent, dies, disappears, or refuses to rectify defective work under the Domestic Building Contracts Act 1995. Every Melbourne residential build over $16,000 must carry it - and the certificate is issued to you before you pay the first deposit. Here is the timeline most buyers only learn about when they need it.

What VMIA actually covers

  • Incomplete work: Cost to complete the build up to 20% of the original contract value, capped at $300,000.
  • Defective work: Structural defects for 6 years, non-structural for 2 years, from completion or termination.
  • Deposit loss: Up to 20% of the contract price if the builder collapses before starting work.

VMIA is a LAST-RESORT scheme. You must exhaust every other remedy first - complaints to the builder in writing, Victorian Building Authority (VBA) complaint, Domestic Building Dispute Resolution Victoria (DBDRV) conciliation, and typically a VCAT order - before VMIA will look at the claim.

The realistic claim timeline

  1. Month 0-2: Builder collapse or disappearance. You gather the paper trail - contract, variations, VMIA certificate, all correspondence, photos.
  2. Month 2-4: DBDRV conciliation. Statutory step before any tribunal action. Free to buyers.
  3. Month 4-9: VCAT application if conciliation fails. You lodge and wait for a hearing date. Fees $500-$2,500 depending on claim value.
  4. Month 9-18: VCAT hearing and determination. You typically need an independent building surveyor's report and a quantity surveyor's cost-to-complete. Budget $4,000-$12,000 for these reports.
  5. Month 18-24: VMIA claim lodged after VCAT determination. VMIA takes 3-6 months to review, negotiate scope, and appoint a rectification builder.
  6. Month 24-30: Rectification work. Depending on complexity and rectification builder availability.

Anyone telling you the process runs faster than this is either optimistic or has not personally been through one. Plan for 18-30 months from collapse to keys back in hand.

Documents to have ready BEFORE anything goes wrong

  • Original signed contract with every schedule.
  • VMIA insurance certificate (the builder gives you this before deposit - keep it filed).
  • Every variation form signed by both parties.
  • Every progress payment invoice and receipt.
  • Photos of work at every stage - dated.
  • Every text, email and letter with the builder - dated.
  • Independent progress inspections at slab, frame, lockup and fixing stages.

Where VMIA falls short

The 20% cap on cost-to-complete is often not enough for high-end builds - a $2m build with a 20% overrun on rectification hits the $300k cap fast. VMIA does not cover any of your legal fees or expert reports through the VCAT process. And VMIA does not cover consequential loss - rental while you wait, storage of belongings, or the interest on your loan through the delay.
