Request a copy directly from the listing real estate agent (not the builder) before signing any contract.
Cooling-off period (VIC - land contract)
After signing a residential land contract in Victoria you generally have 3 clear business days to cool off. The period does not apply to sales by auction (or within 3 days before or after auction), or where you received independent legal advice before signing. Confirm your cooling-off rights with the listing real estate agent or your conveyancer.
Build contract (VIC)
Under the Domestic Building Contracts Act 1995 (Vic), a major domestic building contract carries a 5 business day cooling-off period from the day you receive the signed contract. Ask the builder to provide their VBA registration number, current Domestic Building Insurance (DBI) certificate of currency for builds over $16,000, and a fixed price with full inclusions list before you sign.
Ask about material facts
Before you make an offer, ask the listing agent (and the builder, for the build side) in writing: are there any material facts about this land or build you are aware of - including flood, bushfire, contamination, asbestos, easements, encumbrances, restrictive covenants, heritage listing, or pending council notices? Their answer should be in writing.
